Welding contractors face significant environmental exposures. The physical and chemical processes inherent to metal fabrication, joining, and thermal cutting generate toxic waste, hazardous air emissions, and heavy-metal particulates. Improper management of compressed gases, chemical solvents, and welding slag can result in sudden or gradual releases that impact local ecosystems and natural resources and incur cleanup costs. Furthermore, welding operations inside commercial or residential structures can inadvertently introduce toxic fumes or biological contaminants into building ventilation systems, leading to third-party bodily injury claims.

Waste Generation

Welding contractors can generate hazardous wastes that require special disposal procedures, including spent chemical containers, heavy-metal slag, and contaminated grinding wheels. Improper disposal can contaminate soil and groundwater, resulting in cleanup costs and environmental tort liability.

Stormwater Run-off

Grinding, cutting, and welding operations can release toxic metal dusts containing hexavalent chromium, lead, manganese, and nickel. When these particulates settle on outdoor surfaces, they can enter stormwater run-off. If the stormwater run-off is not properly controlled, contained, and pre-treated before discharge into sanitary or storm drainage systems, it could impact groundwater, surface water quality, and aquatic systems.

Modification Malfunctions

Welding contractors may make modifications to design specifications while at a jobsite. Malfunctions arising from these inputs/changes can create a direct professional responsibility for the contractor.

Mold and Fungi

Welders often work on pressurized water lines, steam systems, or fire sprinkler piping. A microscopic weld defect, leak, or joint failure can slowly release moisture behind walls or under subfloors, resulting in mold growth. Mold can disperse through the building and be absorbed by insulation and other building materials, resulting in costly remediation, third-party bodily injury claims, and disposal liabilities.

Indoor Air Quality

Performing welding modifications or repairs in occupied buildings can compromise indoor air quality by releasing hazardous fumes, including manganese, ozone, and carbon monoxide. If the area where welding operations are performed is not properly vented, or fumes are vented to areas where they are drawn into neighboring HVAC systems, third parties could be exposed, resulting in bodily injury claims.

Legionella

Modifications or extensions to potable water lines or HVAC cooling systems can result in sections of piping where water remains stagnant. This can lead to Legionella growth, a bacterium that causes a potentially fatal form of pneumonia. Exposure of third parties to Legionella-contaminated mists or vapors can result in severe health issues like Legionnaires’ disease.

Combustion and Toxic Gas Releases from Cylinder Failures

The transport, storage, and use of highly pressurized process gases, such as acetylene, oxygen, and argon, present a severe hazard. Leaks in cylinders, valves, or malfunctioning regulators may result in a fire or explosion at a jobsite. Fires and explosions can generate smoke and toxic fumes that impact third parties. Firefighting foams can contain toxic chemicals, including perfluorooctanesulfonic acid and perfluorooctanoic acid, that could create contaminated run-off.

Volatile Organic Compounds

Pre-assembly preparation and post-weld cleanup rely heavily on chemical solvents, degreasers, and anti-spatter sprays. Many of these products contain high levels of Volatile Organic Compounds (VOCs). Short-term inhalation can cause immediate respiratory tract irritation, dizziness, or nausea. Prolonged exposure can cause severe and lasting impacts, such as kidney or liver damage.

Asbestos-Containing Material

Thermal cutting, grinding, and hot work performed on older structural steel or piping can inadvertently disturb existing asbestos-containing material (ACM). This could cause an airborne release of inhalable fibers, resulting in serious health hazards or fatal diseases such as asbestosis, lung cancer, mesothelioma, and other cancers.

Lead-Based Paint

Thermal cutting, grinding, and hot work performed on older structural steel or piping can inadvertently disturb existing Lead-based paint (LBP). Lead exposure can cause significant bodily injury. Work performed on exterior structures can also result in lead leaching into the soil around the structure, creating cleanup liability.

Claims Scenarios & Examples

A welding contractor was hired to install overhead steam piping for a commercial laundry facility. A minor, undetected weld defect in an inaccessible ceiling plenum leaked hot steam over an eight-month period. The persistent humidity led to widespread toxic mold growth throughout the building’s drywall and insulation. The building owner sued the welder for $450,000 to cover mold remediation, structural repairs, and business interruption.
While performing structural repairs on a retail mall's steel joists, a welder failed to isolate the work zone. Highly toxic manganese fumes migrated directly into the primary HVAC intake, where they circulated through several retail stores. Over twenty mall employees and shoppers suffered severe respiratory distress and "metal fume fever," resulting in multiple bodily injury lawsuits and a mall-wide evacuation claim totaling $180,000.
A welding shop conducted heavy grinding and cutting of galvanized steel structural beams in an open outdoor yard. During a heavy rainstorm, accumulated zinc and lead grinding dust washed off the concrete slab and entered an adjacent creek. The local environmental agency traced the heavy metal contamination to the welding facility, resulting in a state-mandated $220,000 cleanup, natural resource damage assessments, and regulatory fines.
A mechanical welder designed and fabricated the structural support joints for a chemical storage tank at an industrial facility. Two years later, a design error in the weld specifications caused a structural joint to shear under pressure, resulting in the tank rupturing. 5,000 gallons of corrosive acid spilled into the soil, threatening a nearby municipal reservoir. Because the root cause was a design error, the resulting $1.2 million cleanup and soil remediation was routed to the contractor's Professional/Pollution liability program.
A welding contractor modified a commercial building's potable water line, leaving a 15-foot stagnant section of piping ("dead leg") during construction. Water pooled inside, warmed to ideal temperatures, and cultivated Legionella bacteria. When the system was fully activated, the bacteria became aerosolized through the building's water fixtures. Three occupants contracted Legionnaires' disease, resulting in a joint lawsuit against the building owner and the welding contractor that settled for $950,000.

Final Consideration

As a contractor you can be faced with the cost to defend yourself against allegations or legal action from pollution related events, regardless if you are at fault or not. Having the proper insurance coverage in place will help fund the expenses incurred to investigate or defend against a claim or suit and provide you with environmental claims handling expertise.
