Telecommunications contractors are tasked with installing, upgrading, and repairing infrastructure such as cell towers, fiber optic cables, and network equipment to ensure reliable connectivity for individuals and businesses. These operations can expose them to environmental liability. Telecommunications contractors encounter various environmental risks, from excavation activities to handling hazardous materials within network equipment. Excavated materials may be contaminated with known or unknown pollutants and require proper handling, containment, transportation, and disposal procedures. Pollutants can be inadvertently spread to uncontaminated areas, and fugitive dust and particulates can be released into the environment. Additionally, the installation and maintenance activities may involve using energy-intensive equipment and chemicals that can contribute to air and water pollution if not managed properly.

Lead Cables

Lead cables were commonly used for older telecommunications infrastructure. They are often buried underground or disposed of improperly, contaminating soil. Over time, lead leaches from the cables, contaminating the surrounding soil and potentially reaching groundwater. This contamination can persist for decades, posing risks to plants, animals, aquatic organisms, and humans through direct contact or plant uptake.

Underground Utilities

Equipment can strike underground utilities, including gas lines, water and sewage pipes, and unknown hazards beneath the surface, such as abandoned storage tanks and septic tanks. An accidental puncture and release of fuels, chemicals, toxic gases, or sewage can contaminate soil and groundwater and release hazardous air emissions, resulting in cleanup costs, bodily injury, and third-party property damage claims.

Subsurface Intrusion

Excavations, directional boring, and other subsurface intrusion can disturb the soil and possibly penetrate an aquifer. Subsurface work can create pathways for contaminants in the soil to migrate off-site or contaminate groundwater or surface water.

Design Error Liability

Contractors may provide design services or input on a design that can result in professional liability. Design services may include performing in-house design, hiring design firms as subcontractors or through a joint venture, or providing professional opinions on design aspects. Errors and omissions can delay time, overrun budgets, and result in rework.

Preconstruction and Jobsite Modifications

Telecommunications contractors can be involved in preconstruction planning and provide input on materials selection, scheduling, and costs. They may also modify design specifications while at the jobsite. Malfunctions arising from these inputs/changes create a direct professional responsibility for the contractor.

Pesticides

If contractors are responsible for vegetation management, leaks, spills, misuse, or over-application of herbicides and pesticides can contaminate soil and water sources. Applications made before heavy rains or on saturated soils can also contribute to contaminated stormwater run-off.

Utility Trench Perforations

Backfilling could damage underground pipes and result in perforations that can release contaminants. When refilling a utility trench, rocks in the backfill or pipe placement on jagged edges can damage the line.

Heavy Equipment

Heavy equipment and portable refueling tanks may be brought to and stay on the jobsite during excavation and grading work. Accidental spills or leaks of fuels, lubricants, oils, and chemicals or vandalism can discharge pollutants into the environment and require cleanup.

Pre-Existing Contaminated Soil

During excavation and grading, unknown pre-existing contaminated soil could be collected and spread to clean areas of a site or create environmental liability in the transportation and disposal of the contaminated soil.

Silt and Sediment

Silt and sediment are fine-grained soil particles that can migrate in run-off due to a rain event, accidental water pipe break, or excessive watering for dust suppression. During construction activities for telecommunication trenches, bare ground and exposed earth is vulnerable to erosion by wind and water. Inadequate erosion controls can lead to surface run-off of these soil particles, impairing the proper functioning of stormwater drainage systems, causing ecological damage to streams and rivers, and causing adjacent property damage. Control of silts/sediments is required under the Clean Water Act. Contractors may face regulatory action such as cleanup orders, fines, and penalties from federal, state, or local regulators.

Claims Scenarios & Examples

A fiber optic cable contractor was hired to install a high-capacity cable network for a telecommunications project. After installation, it was discovered that the cable’s intended load capacity had been exceeded, resulting in excessive deflection. It became evident that the contractor was at fault for using inadequate backfill and bedding materials, combined with heavy equipment that applied excessive pressure on the cable crown. Extensive remedial work was necessary to restore the cable to its intended alignment and ensure optimal signal transmission. The remedial work also created construction delays that resulted in additional expenses. The owner filed a lawsuit against the contractor to recover the additional costs incurred.
Two telecommunications companies released drilling lubricant while installing underwater fiber optic cables. During installation, the contractors failed to contain and recapture the drilling mud, releasing pollutants into the ocean. The release killed aquatic organisms and smothered coral and sea grass. The contractors were found in violation of the Clean Water Act and were required to pay $1.8 million in penalties and clean up the release. The cleanup cost of the release was not disclosed.
A telecommunications contractor ruptured a sewer line while performing trenchwork to lay fiber optic cable. The rupture caused sewer back-ups at nearby businesses, which resulted in lost revenue. The contractor was held responsible for the cost of the business interruption and remediation expenses.
A contractor resolved a lawsuit over pentachlorophenol contamination from utility pole storage. The contractor was forced to clean up a storage facility and prevent stormwater run-off. The utility poles were treated with pentachlorophenol, which contains dioxins and furans, which are toxic chemicals to wildlife.
A utility contractor lost its municipal general contractor license after pleading guilty to a criminal pollution charge. The company performed underground directional drilling and was charged with releasing fluids from worksites into a nearby storm drain. In addition to losing its license, the company was fined and paid restitution fees to cover the cost of the testing and cleanup.
A city in South Carolina hired a contractor to install new telecommunications hardware. The contractor hired a subcontractor to perform the work. The subcontractor failed to notify the city they would be on-site for the work, nor did they secure an encroachment permit from the city. During installation, the contractor punctured and damaged a storm drain, causing a leak. The city sued the prime contractor for $115,000. The city settled with the contractor’s insurance company for $99,500.

Final Consideration

As a contractor you can be faced with the cost to defend yourself against allegations or legal action from pollution or professional related events, regardless if you are at fault or not. Having the proper insurance coverage in place will help fund the expenses incurred to investigate or defend against a claim or suit and provide you with claims handling expertise.
