Recycler - E-waste

Electronic waste (e-waste) recyclers store, process, and dispose of various types of scrap electronics and components, which can contain hazardous materials such as heavy metals and chemicals. Recycling activities to break down devices and identify reusable resources to salvage involve grinding, crushing, stripping, and leaching. These activities produce dust, vapors, smoke, and effluent-containing hazardous materials that can contaminate air, soil, and water and harm human health and natural resources. Additional environmental exposures can result from the storage and use of materials and equipment used in the recycling process, along with the generation and disposal of wastes, which may be hazardous and regulated. E-waste facilities may also collect unwanted electronics and retain liability for improper disposal to facilities not permitted to accept the waste.

Toxic Elements of Electronic Scrap

Electronic scrap components, such as CPUs, printed circuit boards, cathode ray tubes, LCD/LED screens, power packs, computer wires, chips, printers, and keyboards, can contain potentially hazardous materials, including electronic glass, flame retardants, plastics, and heavy metals such as lead, cadmium, arsenic, mercury, silver, tin, chromium, nickel, and beryllium.

Air Emissions

E-waste treatment can include dismantling, crushing, grinding, desoldering, shredding, stripping, smelting, and other operations that create smoke, mists, vapors, dust, and other by-products that contain hazardous or toxic materials. These activities can release hazardous air emissions or accumulate hazardous materials in the facility’s soil, water, and interior spaces, leading to environmental cleanup and causing harm to natural resources and the health of nearby third parties inhaling toxic fumes and particles or ingesting contaminated water and food sources.

Chemicals and Acids

Leaching or extracting precious metals, such as gold, from e-waste can involve chemicals and acids such as cyanide, nitric acid, and hydrochloric acid. Processes that involve heating can release dangerous toxins into the air that can cause skin disorders, liver problems, heart disease, or cancer and impair the immune, endocrine, and reproductive systems. During processing, improper containment of spent materials can result in their release into soil or water sources, damaging natural resources and harming human health. Spills or containment breaches of stored chemicals and acids on-site can contaminate soil and water systems.

Waste Management

E-waste facilities may end up with unwanted electronic waste, which must be disposed of in accordance with local, state, and federal regulations. Much e-waste still ends up in landfills, not permitted to accept such waste, where hazardous materials can leach out and contaminate the soil and underlying groundwater. Anyone disposing of hazardous or universal waste in landfills retains the liability for the damage these wastes might create. Most e-waste recyclers have a non-owned disposal site liability created by waste streams transported to landfills for disposal.

Soil Contamination

Soil contamination can occur from effluent or waste products from leaching practices and particles and ash from dismantling, shredding, or burning practices that can deposit into soils. Contaminants can include heavy metals and flame retardants (PFAs and PFOs), which can persist and remain in the soil for long periods.

Solvents

Cleaning agents and solvents used in demanufacturing or disassembly operations might be flammable, combustible, toxic, or otherwise harmful to the atmosphere, soil, or groundwater. Improper use, storage, or disposal could lead to cleanup liability and third-party claims for bodily injury and property damage.

Stormwater Run-off

Stormwater may come in contact with contaminated soils and outdoor stockpiles of e-waste, which can undergo weathering and release hazardous compounds. If the stormwater run-off is not properly controlled, contained, and pre-treated before discharge into sanitary or storm drainage systems, it can pollute adjacent soil and groundwater or discharge directly into surface waters.

Equipment Fluid Spills

Collection vehicles, conveyor belts, sorting machines, and other production equipment may leak lubricants, oil, grease, or fuel. Spills or leaks can occur from stock supplies or during maintenance and fueling. Releases can contaminate soil, may be collected in stormwater run-off, or contribute to fire hazards.

Regulatory Labeling and Sorting Errors

Many e-waste components are classified as hazardous or universal waste (a category of hazardous waste containing very common materials but still falling under regulatory guidelines) and require special treatment, storage, and disposal procedures. Labeling or sorting errors may lead to improper storage and disposal of waste and result in fines or environmental liability.

E-waste recyclers are in the distribution channel and can be held liable for bodily injury and property damage caused by pollution from products that contain parts from demanufactured or disassembled electronic equipment.

Claims Scenarios & Examples

A recycling facility was found to be mismanaging scrap electronics and CRT devices. As a result, lead and other hazardous substances were leaking into the ground. The Department of Environmental Conservation (DEC) investigated the facility and found 780 tons of e-scrap materials were stored on-site. The recycling company was given a $500,000 fine for mishandling the e-scrap and was ordered to clean up the site and the contaminated soil.
A recycler accidentally released industrial solvents that impacted a waterway that led to a water treatment plant. Due to the contamination, the treatment plant had to be permanently shut down. The recycler was found to be the source of the environmental contamination and was responsible for the cleanup costs, which included property damage and business interruption.
Two warehouse owners sued 30 electronic recycling companies alleging that the companies shipped cathode-ray tube (CRT) glass to businesses that had previously shut down, leaving 316 million pounds of CRT materials at various properties. CRTs have lead in them, and as they began to go obsolete, they had negative value for electronics processors. Cleanup across the various properties of the 158 million pounds of shipped e-scrap was estimated to cost $18.2 million. The claim sought to hold the recyclers responsible for cleanup, and the Superfund law was invoked.
When a hydraulic line ruptured, a waste removal collection truck released 30 gallons of hydraulic oil into a parking lot. The company faced a $38,480 penalty for not immediately notifying the state’s Department of Environmental Protection of the release and failing to promptly investigate and clean up the spill.
State regulators found two electronics recycling companies were mishandling metal-laden dust from e-scrap shredders. The regulators alleged that the recyclers mismanaged the bag-house dust from the shredding process, which contained various metals, and that the dust should have been classified as hazardous. The recyclers were found selling the dust for smelting and refining as they thought it was a recyclable material. The Department of Toxic Substances Control (DTSC) issued violation notices for improper storage, treatment, transportation, and disposal of hazardous waste and hazardous dust found on the facilities’ floor. As part of the settlements, the recyclers agreed to pay $400,000 and $390,000, respectively, and began incorporating better management practices. Under the new protocols, employees were required to sweep the entire plants’ floors at the end of each shift, and storing e-scrap waste on the floor was prohibited; instead, the companies built metal containers to store the material.
