Playground construction contractors face significant environmental exposures. Mold and Fungi Growth Resulting from Improper Drainage Design

Improper grading, sub-base installation, and drainage design beneath engineered wood fiber (EWF) or poured-in-place (PIP) rubber surfacing can allow excessive water to pool and stagnate. This creates a dark, damp environment that accelerates the decomposition of organic play materials and promotes severe mold and fungal growth. When children interact with the porous surfaces above, fungal spores can become airborne, leading to third-party bodily injury claims for allergic reactions, asthma, and chronic respiratory illnesses, as well as potential site remediation and surfacing replacement costs.

Hazardous Release of Polyurethane Binders and Solvents

Modern PIP rubber surfaces require large volumes of liquid polyurethane binding agents mixed on-site, along with aromatic solvents used to clean application tools. Improper mixing, accidental spills, or equipment washwater run-off can rapidly leach chemicals into the underlying soil or migrate into municipal storm sewer systems. Exposing third parties or waterways to these toxic binding agents can result in severe damage to natural resources and costly emergency response claims.

Disposal Liability from Legacy Chromated Copper Arsenate (CCA) Treated Wood

Many older wooden playground structures built prior to the mid-2000s were treated with CCA to prevent decay. Dismantling, cutting, or chipping this wood generates hazardous, arsenic-laden dust that can contaminate the immediate soil and harm workers or bystanders. If a contractor improperly disposes of CCA-treated timber in a standard municipal landfill rather than a designated hazardous waste facility, they could face severe regulatory penalties and retroactive cleanup liability under CERCLA (Superfund) as a waste handler.

Excavation and ground disturbance for playground footings, retaining walls, and utility connections can uncover historical soil contamination, such as urban fill containing lead, agricultural pesticides, or industrial solvents. Additionally, recycled styrene-butadiene rubber (SBR) tire crumb used in older playgrounds has been shown to contain heavy metals and synthetic chemicals, such as PFAS. Improper identification and inadvertent disturbance of these materials can cause airborne dust migration or leaching, leading to third-party bodily injury lawsuits and mandatory environmental remediation.

Pathogen Exposure from Underground Utility and Sewer Disruption

Direct-push drilling, auguring, or trenching for playground equipment posts and perimeter fencing can inadvertently strike poorly mapped underground utilities, including sewage or septic lines. A ruptured sewer line releases raw sewage into the open excavation site, exposing workers, neighborhood children, and the surrounding environment to dangerous biological pathogens, bacteria, and viruses, resulting in emergency biohazard cleanup costs and bodily injury claims.

Fumes, Off-Gassing, and Spills from Adhesives and Sealants

Materials used during the assembly and coating of playground structures, such as industrial adhesives, sealants, anti-graffiti coatings, surfactants, and degreasers, often contain high levels of Volatile Organic Compounds (VOCs). These products can release irritating or toxic fumes during application and curing. Failure to properly ventilate indoor play facilities or restrict public access during outdoor curing can result in third-party respiratory claims. Spilling these chemicals on the jobsite or discharging residuals down storm drains creates additional environmental liability.

Heavy Equipment Fluid Releases and Chemical Spill Hazards

The use of skid steers, mini-excavators, and trenchers introduces the risk of hydraulic line ruptures, refueling spills, and motor oil leaks. A blown hydraulic hose over a permeable sandbox, natural grass field, or porous sub-base can contaminate cubic yards of soil in seconds. Furthermore, combinations of incompatible chemicals stored on-site during construction can react violently or produce toxic byproducts if accidentally mixed during a spill or transportation accident.

Contractors are responsible for determining whether surfacing waste they remove, such as old synthetic turf carpets, degraded rubber mulch, and chemical containers, is subject to specialized environmental disposal regulations. Illegally dumping or improperly routing these materials to non-permitted disposal sites can lead to substantial environmental tort liability, regulatory fines, and ongoing residual cleanup responsibilities.

Off-Site Migration of Dust and Stormwater Runoff

Failing to implement and maintain Stormwater Pollution Prevention Plans (SWPPPs) allows chemical-laden sediment, silt, and contaminated mud to migrate off-site. Claims Scenarios & Examples

A contractor was hired to demolish a 30-year-old wooden playground and install a modern play structure. The original structure was built using CCA-treated timber. During demolition, the contractor sawed and chipped the wood on-site, spreading arsenic-contaminated sawdust across the surrounding public park soil. The contractor then transported the debris to a standard municipal construction debris landfill that was not permitted to receive hazardous CCA waste. The state Department of Environmental Protection fined the contractor for improper hazardous waste disposal and mandated an extensive soil remediation protocol at the park, resulting in over $180,000 in cleanup costs and legal fees.
While installing a poured-in-place (PIP) rubber safety surface at an elementary school, a contractor’s crew accidentally tipped over a 55-gallon drum of liquid polyurethane binding agent. The chemical flowed across the asphalt base and poured directly into an adjacent municipal storm drain that emptied into a protected freshwater creek. The local environmental protection agency mandated an immediate emergency hazmat response to flush the storm lines and contain the river plume. The contractor faced $120,000 in first-party emergency response costs and municipal fines.
A design-build playground contractor constructed an inclusive playground featuring an engineered wood fiber (EWF) surface. Dozens of patrons and employees suffered acute VOC exposure, experiencing dizziness, nausea, and severe asthma attacks. The contractor faced numerous third-party bodily injury lawsuits and, due to a standard absolute pollution exclusion in its General Liability policy, was forced to absorb substantial defense costs.

A general contractor hired a local hauling subcontractor to remove and dispose of 10,000 square feet of synthetic turf and recycled SBR rubber crumb during a school playground upgrade. To save money, the subcontractor dumped the rubber waste on an unpermitted vacant rural lot rather than taking it to a licensed environmental recycling facility.
